    Abstract:
    The economy has undergone numerous changes over the past 40 years, the most significant being the transition from a planned to a market economy. This process, which began in 1992, was far from smooth and measured, allowing society time to adapt to the new system, but rather abrupt, eliminating any opportunity to adjust to the inexorable pace of development and change. The main difference between a planned and a market economy is the mechanism for resource allocation and pricing: In the Soviet Union, the state acted as the sole controller and regulator, determining the quantity, cost, and distribution of manufactured goods. In the Russian Federation, these powers are vested in individual entrepreneurs and legal entities, with rare exceptions, such as government contracts. However, even though this area is completely under state control, this does not mean it is immune to fraudulent schemes.

    Abstract:
    Статья посвящена актуальной проблеме правового регулирования института аффилированности в российском праве. Автор анализирует существующие подходы к определению аффилированных лиц в различных отраслях законодательства, выявляет противоречия и пробелы правового регулирования. Обосновывается необходимость формирования единого межотраслевого понятия аффилированности и выработки универсальных критериев идентификации таких лиц для повышения эффективности правоприменительной практики. Рассматриваются позиции ведущих ученых-правоведов по данной проблематике, анализируется современная судебная практика и тенденции правового регулирования в условиях цифровизации экономики.

    Abstract:
    A comprehensive study of the main theoretical and practical aspects of the institute of affiliated persons in the Russian legal reality in its systemic correlation forms the subject of this author's work. The article reveals the legislative structure of affiliation, its doctrinal interpretation in the context of various legal segments. The conclusion is substantiated that it is necessary to adopt a single federal law as a kind of author's intention, its final result in the context under study, taking into account all the legal nuances of recognition and activity of affiliated persons in the Russian Federation in order to avoid negative legal consequences of various kinds and properties.
