    В статье рассматривается принцип действия международного договора во времени, анализируется механизм связи указанного принципа с действием международного договора в целом. При этом подчеркивается, что действие отдельной договорной нормы может существенным образом отличаться от действия договора в целом. Авторы рассматривают некоторые варианты квалификации действий лица, совершившего международное преступление, в свете реализации принципа действия уголовного закона во времени, исследуются некоторые аспекты обратной силы международного уголовного закона.

    Abstract:
    Статья посвящена исследованию объективной истины в праве, анализу практического значения получения истины в гражданском праве Российской Федерации. Формально-правовые методы применяются для многостороннего анализа законодательства и реализации сущности объективной истины в законодательстве. С применением диалектического метода выявляются гносеологические основания и их сущность для осуществления законодательной деятельности. В статье отражены взгляды исследователей на содержание истины и реализацию принципа объективной истины в праве. Делается вывод о необходимости определения принципа объективной истины, который должен проникать в сферу не только правоприменения, но и образования законов. Определено предложение о необходимости выделения и нормативного закрепления принципа объективной истины в гражданском праве в качестве самостоятельного принципа.

    Abstract:
    Статья посвящена анализу факторов, предопределивших возникновение в уголовном законодательстве Российской Федерации нового института судебного штрафа. Предметом настоящего исследования являются источники международного и российского права, закрепляющие принципы восстановительного правосудия и необходимость регламентации альтернативных мер урегулирования уголовно-правового конфликта. Методологической основой исследования являются такие методы познания, как анализ, синтез, обобщение, сравнение, сопоставление, формально-юридический, формально-логический, формально-юридический, системный методы. В результате автором выделяются аспекты международного, внутригосударственного и социально-гуманистического характера, обусловившие появление положений о судебном штрафе в отечественном уголовном законодательстве, реализация которых удовлетворяет потребности всех участников уголовно-правового конфликта.

    Abstract:
    This paper analyzes the following principles of Russian education: the principle of state funding of science and education, the principle of state responsibility of scientists for the development of science and education, the principle of responsibility and continuity. The genesis and the ontological concepts of philosophy in soil science are shown, some of the main provisions of the scientific and the philosophical, pedagogical, organizational and exhibition activities of E.D. Nikitin are given, and it is indicated that he created scientific and philosophical theory, revealing the main regularities of the relationship between man and nature, homolaterally (theory of the unity of man and nature), highlighted the versatility of feedback, based on the understanding of which, E.D. Nikitin has identified and classified the variety of geosphere, atmosphere and biogeocenosis features of soils and undertook philosophical and scientific generalization on this issue. Continuity in the work of the department «Natural zoning and soil formation» from the 50s of the XX century to the present time is revealed.

This, in turn, requires strategic development of intellectual capital. The work deals with the components and content of the process of such development. The concept of educational intellectual capital is given and it is shown that the strategic development of educational intellectual capital should provide the necessary compliance and understanding of the external environment.     Abstract:
    The article discusses the main ideas of the pedagogical concept of V. A. Sukhomlinsky, identifies their philosophical roots, points out the consonance with the ideas of world philosophy. The researcher poses the problem of creative rethinking by the great teacher of the teachings of Marxism-Leninism, in particular the code of the builder of communism, the question of the consonance of his doctrine to the humanistic ideas of world philosophy, the problem of conformity of the doctrine to a religious worldview. In work, generally, the comparative-historical method is used. The author comes to the conclusion that the direct philosophical foundations of the pedagogical concept of V. A. Sukhomlinsky are the Marxist-Leninist teaching, the creatively rethought code of the builder of communism, the philosophy of humanism of the Renaissance. At the same time, his teachings are partially consonant with the humanistic concepts of the philosophy of all eras; especially the teachings of the ancient
